THE RECLAIMED FLOORING CO (RFC) TERMS & CONDITIONS

The following terms and conditions apply to your use of the RFC 
Website and to all orders placed. An agreement to sell you the product is based on these terms when we accept your order through our website or in person, by email or by phone.

Product information

Due to the age and use of recycled timbers, variations between the colour, pattern and texture of the products and the images show on this website are to be expected. All product descriptions, illustrations are intended as guidance only and the actual products themselves will vary accordingly to each individual piece of flooring or timber. 
Every effort will be made to keep the prices on the website up to date but the right is reserved to alter the prices at any time.

Reclaimed flooring

Timber supplied in a reclaimed state or in an ‘as is’ condition, it will need some form of finishing on site after installation. Some minor cleaning of the product is to be expected and carried out prior to fitting. Cracks and nail holes in the timber are deemed as usable and strong if fitted correctly with nails, we generally advise customers that a reclaimed floor is not fit for glueing or to be fitted as a floating floor. Timber planks may have a slight warp that may require a strong fix and securing with nails or screws, these are standard potential characteristics and part of the natural beauty of all reclaimed boards. We would always recommend that an experienced contractor be used, especially for the final finishing and fitting of a reclaimed floor. Whilst the RFC takes all care to ensure that all its reclaimed materials are good and useable, it has to be considered that contamination of various types will always be apparent in reclaimed timber. This can be visible after sanding by way of colour contamination from years of paint and oxidisation marks from metal fixings etc. Occasional patches of end decay will be allowed for and trimmed where possible. The resin and oil content of old timber usually dissuades any pest attack, but occasionally small areas may be discovered and removed or treated. We cannot guarantee freedom from any of the above and more, but most clients consider these as cosmetically pleasing features that are within the bounds of their salvaged material requirements.

Grade of timber

Reclaimed timber is supplied in a reclaimed state or in an ‘as is’ condition, within one lot of timber there will be present various grade from Premium, Character, Full Rustic. Whatever the grade, if flitted correctly by an experienced reclaimed timber floor fitter these boards may take more time to lay but once fitted will present no structural problems.

Premium Grade boards are the most expensive and present minimal cracks and wholes.

Character Grade boards present minimum cracks, nail holes, scrapes, edge markings.

Full Rustic boards a full range of all the above and possible more.

Measurements are approximate.

Orders

Orders are normally accepted if the timber is available, or becoming available, if the order reflects the current pricing and if your credit or debit card is authorised for the transaction.

Delivery in the UK

The delivery charge will be added to your payment at the point of purchase. 
If the item is in stock it will be despatched within the agreed time. If your purchase requires specific timber modification time or Pre-Finishing time extra time maybe requires, delivery dates are estimated only, although every effort will be made to despatch your order within the agreed time. You will be contacted and given the option to cancel the order if your order is delayed, a fee may be taken from your deposit.

  • Deliveries are to the property and not inside the property.
  • The Customer is responsible for unloading goods with his own labour and without undue delay.
  • The customer must organise adequate labour to unload. Failure to do so may result in the delivery being returned to our warehouse and a charge for delivery being made.
  • Space for the delivery vehicle will need to be reserved if the delivery takes place in a narrow road where there is no passing room for other vehicles. Failure to do so may result in the delivery being returned to our warehouse and a charge for delivery being made. Any parking tickets issued while unloading will be billed to and paid for by the customer.
  • RFC is not responsible for stacking the wood.  Stacking advice is available on request.
  • Extra distance unloading is available at extra cost.

Overseas orders

Please be aware that all shipments outside the UK may be subject to duties and taxes levied once the shipment reaches your country. We cannot predict what these may be and you will be liable for all customs clearance charges. You are not entitled to cancel your order on the basis of unforeseen duties or levies.

Payment

All prices on the website are in pounds sterling and all products will remain our property until we have received payment in full for those products.Please make cheques payable to THE RECLAIMED FLOORING CO and expect to allow a min of 5 working days from receipt to despatch to allow for banking and clearance. Card payments can be made over the phone, and via our website. For certain credit cards an additional 2.5%-3% will be added to the final balance, we will notify you of these additional charges before purchase.
If we cannot supply the goods you have ordered we will inform you by email and your payment will be fully refunded.

Refund/Replacement

The website explains clearly that the nature of reclaimed flooring is such that each piece is unique to itself, samples and photographs are for ref only. If the item is faulty, damaged in any way other than wear and tear that is to be expected with genuine reclaimed timber then you should contact us to arrange for a replacement or a refund for the item which will be sent to you on the receipt of the returned item. Items may not be returned for a refund if the flooring has been tampered with, damaged, dented or cut in any way after purchase. For all genuine reclaimed floorboards it is considered standard practice to ‘air’ all floorboards in the environment where they are to be layed for a min of 10 days, with normal internal heating turned on and good airflow between each board. This will help the boards settle in to their new environment and prevent potential warping. Please see our ‘AFTERCARE’  page in the main menu for more details.

Cancelation

RFC reserves the right to hold onto the deposit in full or to hold onto a percentage of the deposit as a cancelation fee, the cancelation fee is independant and specific to each particular order.

Business Customers

We have selected our products on the basis that they will be used for domestic use only, if you are planning to use them for business purposes please make sure that you are covered by the appropriate insurance. Where you decide to use the products in the course of a business, we exclude (to the fullest extend permitted by law) those warranties and conditions relating to fitness for a particular purpose. Our maximum liability to business users arising out of or in connection with the products shall be limited to the replacement value of the product in question (except in the case of death or personal injury caused by our negligence or in respect of fraud). In relation to business users, we do not accept liability for the fitness of goods for business purposes, nor do we accept liability for loss of use of the item nor any loss over and above the cost of the item in the event of a claim for breach of warranty or condition.

Security

We endeavour to take all reasonable steps to protect your personal information. However, we cannot guarantee the security of any data you disclose on-line. You accept the inherent security risks of providing information and dealing on-line over the Internet and will not hold us responsible for any breach of security unless this is due to our negligence or wilful default. RFC uses industry standard practices to safeguard the confidentiality of your personal identifiable information. RFC treats data as an asset that must be protected against loss and unauthorised access.

Privacy

As a matter of policy, RFC will never sell or rent your personal information to third parties without your explicit consent. We will not hold or store your credit card information, it will be destroyed upon completion of purchase.

Intellectual Property Rights

You acknowledge and agree that we own all present and future copyright, registered and unregistered trademarks, design rights, unregistered designs, database rights and all other present and future intellectual property rights and rights in the nature of intellectual property rights existing or in relation to the products and website. You are permitted to use the content only as expressly authorised by someone acting on behalf of RFC. You agree not to assist or facilitate any third party to copy, publish, reproduce, transmit or distribute any of the above listed content. Violators will be prosecuted to the fullest extent permissible under applicable law.

Liability

Except in respect of death or personal injury caused by RFC’s
negligence, RFC shall not be liable to you for any loss or damage (such term to include without limitation economic loss, administrative and overhead costs, loss of profits (whether direct or indirect) business contracts, revenues, goodwill, production and anticipated savings of every description, loss). RFC will not be liable to you by reason of any delay in performing or any failure to perform any of RFC‘s obligations in relation to the product in the delay and failure was due to any cause beyond our control. RFC’s liability to you in all other instances shall not exceed the value of the product ordered by you.
